\-. \- City of Elk River City Council Resolution 20-37 A Resolution of the City Council of the City of Elk River Approving the Conveyance of Certain Property (PlD 75-127-4302) to Elk River Municipal Utilities WHEREAS, the City of Elk River (the *CiY) is the fee owner of the following desctibed property: That patt of the Southwest Quarter of the Southeast Quarter of Section 27, Township 33, Range 26, Sherbume Cotrnty, Minnesota, desctibed as follouzs: Commencing at the Southwest cornet of said Sout}uzest Quartet of the Southeast Quarter of Section 27; thenlce Eastetly along the South line of said Southwest Quartet of the Southeast Quarter of Section 27 a drstance of 507 .6 feet more ot less to the tUTesterly oght- of-way of U.S. Highway No. 169 and the point of beginning of the patcel to be desctibed; thence Northetly along said lUTestetly dght-of-way a distance of 208.0 feeq thence Westetly parallel with said South line of the Southwest Quarter of the Southeast Quartet a distance of 278.7 feet; thence Southerly parallel with said Westetly dght-of-way of U.S. Highway No. 169 a distance of 208.0 feet to said South line of the Southwest Quartet of the Southeast Quarter of Section 27; therrce Easterly along said South line to the point beginning. (the "Property'); and WHEREAS, the City desires to convey the Property to Elk River Municipal Utilities, a Minnesota municipal utility ('ERMU'); and NOW, THEREFORE, BE !T RESOLVED by the City Council of the City of Elk Rivet, Minnesota, by at least fout-fifths vote: 7. The conveyance of the Property by the City to EMRU has no telationship to the City's Comprehensive Plan and therefote, rcview of the conveyance by the Plaffung Commission pursuaflt to Minnesota Statutes Section 462.356, subdivision 2 is not tequired 2. The City ho.by approves the conveyance of the above desctibed Property to ERMU. 3. The Mayor and City Clerk ate hereby authorized and dfuected to take dl actions necessary to convey the Ptoperty to ERMU, including execution of any and all documents needed for the conveyance and to effectuate the intent of this Resolution. ttt \-
