<br />RESOLUTION 88 - 61 <br /> <br /> <br />A RESOLUTION OF THE CITY OF ELK RIVER <br /> <br /> <br />. A RESOLUTION FOR VACATING A DRAINAGE AND UTILITY EASEMENT <br /> <br />. <br /> <br />. <br /> <br />WHEREAS, a majority of the property owners abutting the drainage <br />and utility easement have requested the City Council in <br />a petition dated July 1, 1988 to vacate such easement <br />according to law; and, <br /> <br />WHEREAS, a public hearing was held on August 15, 1988 before the <br />City Council at the Elk River Public Library on such <br />petition after due published and posted notice had been <br />given, as well as personal notice to affected property <br />owners by the clerk on August 5, 1988 and all persons <br />interested were given an opportunity to be heard; and, <br /> <br />WHEREAS, it appears that it will be in the best interest of the <br />City to approve such petition; <br /> <br />NOW, THEREFORE, BE IT RESOLVED, that such petition is hereby <br />granted and the drainage and utility easement described <br />as follows is hereby vacated: <br /> <br />The North 3 feet of the South 5 feet of Lot 7, Block 2, <br />except the East and West 10 feet thereof, in the plat <br />of Wilderness Acres, Sherburne County. <br /> <br />Passed and adopted this 15th day of August, 1988, by the City <br />Council of the City of Elk River. <br /> <br />Cudb C A~~ <br /> <br />Estelle E.
