<br />Notice of Completion of Proceedings <br /> <br />RESOLUTION 88-53 <br /> <br />. <br /> <br />A RESOLUTION OF THE CITY OF ELK RIVER <br /> <br />A RESOLUTION FOR VACATING RIGHT-OF-WAY <br /> <br />WHEREAS, a majority of the property owners abutting the right-of- <br />way have requested the City Council in a petition dated <br />June 24, 1988, to vacate such right-of-way according to <br />law; and, <br /> <br />WHEREAS, a public hearing was held on 7/18/88 before the City <br />Council at the Elk River Public Library on such <br />petition after due published and posted notice had <br />been given, as well as personal notice to affected <br />property owners by the clerk on 7/8/88 and all persons <br />interested were given an opportunity to be heard; and, <br /> <br />WHEREAS, that portion of the right-of-way is no longer used or <br />maintained by the City, and; <br /> <br />WHEREAS, it appears that it will be in the best interest of the <br />City to approve such petition; <br /> <br />NOW, THEREFORE, BE IT RESOLVED, that such petition is hereby <br />granted and the right-of-way described as follows is <br />hereby vacated: <br /> <br />. <br /> <br />That part of the following described property lying <br />Northerly of the South 75.00 feet, as measured at right <br />angles, thereof: <br />That Part of Lots 1, 2, 3, and 4, Block 2, of the duly <br />recorded Auditor's Addition, City of Elk River, <br />Sherburne County, Minnesota, described as follows: <br />Beginning at the Northwest corner of said Block 2; <br />Thence Southeasterly along the North line of said Block <br />2 for 90.00 feet; Thence Southeasterly parallel with <br />the East line of said Lots 1 through 4 inclusive for <br />243.00 feet; Thence Westerly to a point on the West <br />line of said Block 2, which point is 232.00 feet <br />Southwesterly from said Northwest corner of Block 2; <br />Thence Northeasterly along said West line of Block 2 <br />for 232.00 feet to the point of beginning. <br />Subject to that part thereof taken from Main Street <br />being further described as that part thereof lying <br />Northwesterly and Northerly of the following described <br />line: Commencing at the point of intersection of two <br />following described centerlines: <br />1) A centerline 33.00 feet westerly of, as measured at <br />right angles to, said West line of Block 2; <br /> <br />. <br />
