<br />. <br /> <br />e <br /> <br />e <br /> <br />THE CITY COUNCIL FOR THE CITY OF ELK RIVER, MINNESOTA <br /> <br />RESOLUTION NO. 90-~ <br /> <br />A RESOLUTION APPROVING AN AGREEMENT BY AND BETWEEN THE CITY <br />OF ELK RIVER, NORTHERN STATES POWER COMPANY, AND UNITED <br />POWER ASSOCIATION <br /> <br />RECITALS <br /> <br />WHEREAS, the State of Minnesota, through the enactment of <br />the Solid Waste Management Act of 1990, Minnesota Statutes <br />Chapter lISA, has declared it to be the state policy to improve <br />waste management through the separation and recovery of energy <br />and materials from solid waste and through the reduction of the <br />dependence on land disposal; and <br /> <br />WHEREAS, in furtherance of the above state policy, Anoka <br />County, Hennepin County, Sherburne County and the Tri-County <br />Solid Waste Management Commission (collectively referred to as <br />the Counties) each have entered into Service Agreements (the <br />Service Agreements) with Northern States Power Company (NSP) to <br />define the rights and obligations of NSP and the Counties with <br />respect to the management, operation and maintenance of a <br />waste-to-energy processing facility located at 10700 165th <br />Avenue N.W., Elk River, Minnesota (the Facility) to convert <br />mixed municipal solid waste into fuel for incineration at the <br />United Power Association (UPA) Elk River Station located at <br />17845 U.S. Highway 10, Elk River, Minnesota (the Power Plant); <br />and <br /> <br />WHEREAS, the Facility and the Power Plant are located <br />within the corporate boundaries of the City of Elk River (the <br />City); and <br /> <br />WHEREAS, the City has requested, that the City be <br />compensated for costs incidental to the location of the <br />Facility and the Power Plant within the City; and <br /> <br />WHEREAS, the City, NSP and UPA have agreed, on the terms <br />and conditions set forth in an agreement dated December 17, <br />1990, among the City of Elk River, NSP and UPA (the Agreement). <br /> <br />~ <br /> <br />RESOLVED <br /> <br />The City Council for the City of Elk River does hereby <br />approve and adopt the terms and conditions of the Agreement <br />dated December 17, 1990. <br />
