. e e THE CITY COUNCIL FOR THE CITY OF ELK RIVER, MINNESOTA RESOLUTION NO. 90-~ A RESOLUTION APPROVING AN AGREEMENT BY AND BETWEEN THE CITY OF ELK RIVER, NORTHERN STATES POWER COMPANY, AND UNITED POWER ASSOCIATION RECITALS WHEREAS, the State of Minnesota, through the enactment of the Solid Waste Management Act of 1990, Minnesota Statutes Chapter lISA, has declared it to be the state policy to improve waste management through the separation and recovery of energy and materials from solid waste and through the reduction of the dependence on land disposal; and WHEREAS, in furtherance of the above state policy, Anoka County, Hennepin County, Sherburne County and the Tri-County Solid Waste Management Commission (collectively referred to as the Counties) each have entered into Service Agreements (the Service Agreements) with Northern States Power Company (NSP) to define the rights and obligations of NSP and the Counties with respect to the management, operation and maintenance of a waste-to-energy processing facility located at 10700 165th Avenue N.W., Elk River, Minnesota (the Facility) to convert mixed municipal solid waste into fuel for incineration at the United Power Association (UPA) Elk River Station located at 17845 U.S. Highway 10, Elk River, Minnesota (the Power Plant); and WHEREAS, the Facility and the Power Plant are located within the corporate boundaries of the City of Elk River (the City); and WHEREAS, the City has requested, that the City be compensated for costs incidental to the location of the Facility and the Power Plant within the City; and WHEREAS, the City, NSP and UPA have agreed, on the terms and conditions set forth in an agreement dated December 17, 1990, among the City of Elk River, NSP and UPA (the Agreement). ~ RESOLVED The City Council for the City of Elk River does hereby approve and adopt the terms and conditions of the Agreement dated December 17, 1990.
