<br />RESOLUTION 90 - 66 <br /> <br />. <br /> <br />RESOLUTION FOR THE CITY OF ELK RIVER <br /> <br />A RESOLUTION FOR ADDING CERTAIN PROPERTY <br />TO THE PLANNED URBAN SERVICE AREA <br /> <br />WHEREAS, the property owner within the affected property has <br />requested that the City Council add the affected <br />property to the Planned Urban Service area; and, <br /> <br />WHEREAS, the City Engineer has reviewed the request and <br />determined that the City does have the capacity to <br />service this area; and, <br /> <br />WHEREAS, a public hearing was held on October 23, 1990, before <br />the Planning Commission and on November 19, 1990, and <br />November 26, 1990, before the City Council at the Elk <br />River Public Library on a request to rezone the <br />property from R-1c, single family and R-2b, townhouse <br />and multiple family to R-3, townhouse and multiple <br />family, as well as add the affected property to the <br />planned urban service area after due published notice <br />had been given as well as personal notices to affected <br />property owners by the Clerk on October 12, 1990, and <br />all persons interested were given an opportunity to be <br />heard; and, <br /> <br />4It WHEREAS, it was the recommendation of the Planning Commission, <br />and was adopted by Ordinance Amendment 90-47 to the <br />City's Zoning Map by the City Council, to rezone the <br />affected property from R-1c and R-2b to PUD; and, <br /> <br />WHEREAS, the underlying land use of HR, high density <br />residential, was deemed appropriate for the affected <br />property by the City Council; and, <br /> <br />WHEREAS, the HR land use designation would require the property <br />to hook up to City sewer and water. <br /> <br />NOW, THEREFORE, BE IT RESOLVED that said request is hereby <br />granted and the affected property described as follows <br />is hereby added to the Planned Urban Service area: <br />SEE ATTACHED EXHIBIT A. <br /> <br />Adopted by the City Council <br />Minnesota, this 26th day of <br /> <br />of the City 01 Elk River, <br />November, 19JO. ~ <br />I. .-. <br />i /1 / /7 <br />/~ /J / <br />~?tU!'4lT~' <br /> <br />James A.
