<br />e <br /> <br />e <br /> <br />e <br /> <br />RESOLUTION 90-39 <br /> <br />RESOLUTION FOR THE CITY OF ELK RIVER <br /> <br />A RESOLUTION REFLECTING THE AGREEMENT BETWEEN BURLINGTON <br />NORTHERN RAILROAD, MNDOT AND THE CITY FOR THE INSTALLATION <br />OF RAILROAD CROSSING SIGNALS AT 165th AVENUE <br /> <br />BE IT RESOLVED, that the City of Elk River enter into an <br />agreement with Burlington Northern Railroad Company and the <br />Commissioner of Transportation for the installation and <br />maintenance of railroad crossing signals at the intersection of <br />165th Avenue NW (MUN 106) with the tracks of Burlington <br />Northern Railroad Company in Elk River, Minnesota, and <br />appointing the Commissioner of Transportation agent for the <br />City to supervise said project and administer available Federal <br />Funds in accordance with Minnesota Statute, Section 161.36. <br />The City's share of the cost shall be zero percent of the total <br />signal cost. <br /> <br />BE IT FURTHER RESOLVED, that the Mayor and City Clerk are <br />hereby authorized to execute said agreement for and on behalf <br />of the City. <br /> <br />Passed and adopted by the City Council of the City of Elk River <br />this 10th day of September, 1990. <br /> <br />II. ---Gd' /' <br />f ,---. - <br /> <br />__ /~;';J{d'/ II k /({ <br />James A.
