City of <br /> Elk Re <br /> River quest for Action <br /> To Item Number <br /> Housing and Redevelopment Authority 7.3 <br /> Agenda Section Meeting Date Prepared by <br /> General I August 3,2020 Amanda Othoudt,ED Director <br /> Item Description Reviewed by <br /> Stained Glass Window Settlement Cal Portner, City Administrator <br /> Reviewed by <br /> Action Requested <br /> Approve,by motion, a release of claims for personal property. <br /> Background/Discussion <br /> The HRA entered into a purchase agreement on August 5, 2019, and closed on the property on September 13. <br /> Following the purchase and before demolition, the sellers were to remove a stained-glass window. Staff <br /> contacted the sellers and asked them to remove the window on November 18, 2019. <br /> On November 26, 2019, staff met with the sellers onsite and noticed the window was missing. A police report <br /> was filed and a couple leads did not come to fruition. The sellers requested an insurance claim form on <br /> December 31. The form was sent on January 2, 2020, to return it to the city for processing. <br /> The sellers submitted the form directly to our insurance provider LMC-IT on March 11, 2020. The LMC-IT <br /> informed staff they are not able to process the claim because it was received by a third party and not the city. <br /> The LMC suggested we work with the previous owners directly to settle the issue. The LMN-IT researched and <br /> provided five similar stained-glass windows for sale. The average cost of those windows was used to negotiate a <br /> fair value with the sellers. <br /> Financial Impact <br /> Payment to the sellers of$526 to come from the Main/Gates Redevelopment project budget,releasing all <br /> claims against the HRA or the city relating to the property or the stained-glass window. <br /> Mission/Policy/Goal <br /> The goal of the HRA is to acquire properties along Main St. NW, Gates Ave. NW and 3rd St. NW as part of a <br /> redevelopment project initiated by Mississippi Connections Plan.
