City of Elk River <br />1VCr City Council <br />Resolution 20- 38 <br />A Resolution of the City Council of the City of Elk River Approving the <br />Conveyance of Certain Property (PID 75-402-0082) to Elk River Municipal <br />Utilities <br />WHEREAS, the City of Elk River (the "City") is the fee owner of the following described <br />property: <br />That part of Lot Eight (8) Auditor's Subdivision No. 3 lying Northerly of a line <br />commencing at a point on the West Line of said Lot Eight (8), 360 feet distant North <br />of the iron pipe at the Southwest corner of said Lot Eight (8) to the Great Northern <br />Railroad right-of-way and there terminating; and West of a line running parallel with <br />and 240 feet distance East of the West line of said Lot Eight (8). <br />Together with the right to enter upon the East Ten (10) feet of the West Seventy (70) <br />feet of the South 373 feet of Lot Eight (8), Auditor's Subdivision No. 3 for purposes of <br />} placement, construction, operation, repair and maintenance of a water main. <br />u <br />(the "Property"); and <br />WHEREAS, the City desires to convey the Property to Elk River Municipal Utilities, a <br />Minnesota municipal utility ("ERMU"); and <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk <br />River, Minnesota, by at least four -fifths vote: <br />The conveyance of the Property by the City to EMRU has no relationship to <br />the City's Comprehensive Plan and therefore, review of the conveyance by the <br />Planning Commission pursuant to Minnesota Statutes Section 462.356, <br />subdivision 2 is not required. <br />2. The City hereby approves the conveyance of the above described Property to <br />ERMU. <br />3. The Mayor and City Clerk are hereby authorized and directed to take all <br />actions necessary to convey the Property to ERMU, including execution of <br />any and all documents needed for the conveyance and to effectuate the intent <br />of this Resolution. <br />P 0 N E A 1 0 <br />!U 0 P <br />NA <br />
