<br /> <br /> <br />RESOLUTION 91 - 68 <br />RESOLUTION FOR THE CITY OF ELK RIVER <br /> <br />e <br /> <br />A RESOLUTION ADOPTING A POLICY TO ALLOW <br />DEVELOPMENT ON NONCONFORMING LOTS OF RECORD <br /> <br />WHEREAS, the City recognizes that a number of nonconforming lots of <br />record exist within the City limits; and, <br /> <br />WHEREAS, the City of Elk River understands that it will receive <br />requests to allow development of these nonconforming lots <br />of record; and, <br /> <br />WHEREAS, the City of Elk River desires consistent application of <br />standards to determine if a nonconforming lot of record is <br />buildable. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City <br />of Elk River that it is the City of Elk River's policy to <br />allow development of nonconforming lots of record if the <br />following criteria are met: <br /> <br />1. That the lot met the appropriate standards and gained <br />the necessary approval when it was originally created. <br /> <br />2. That the lot has adequate access to a public street. <br /> <br />3. <br /> <br />That a structure can be built on the lot meeting <br />appropriate dimensional regulations or has been <br />granted a variance to those standards. The structure <br />must also meet other applicable standards. <br /> <br />e <br /> <br />4. That a conforming septic system can be placed on the <br />lot if the lot is not served by public sewer. <br /> <br />Groups of two or more contiguous lots under the same <br />ownership that do not meet the above mentioned <br />criteria shall not be considered as separate parcels <br />of land for the purposes of sale or development and <br />must be combined or rearranged so as to meet the <br />criteria set forth.
