Tralle, Mayor <br /> <br /> <br />RESOLUTION 91 - ~ <br />RESOLUTION FOR THE CITY OF ELK RIVER <br /> <br />e <br /> <br />r <br />A RESOLUTION ESTABLISHING CONSTRUCTION <br />DEBRIS LANDFILL FEE . <br /> <br />WHEREAS, <br /> <br />the City of Elk River (the City) is a Minnesota municipal corporationj <br />and, <br /> <br />WHEREAS, <br /> <br />the 1991 regular session of the Minnesota Legislature amended <br />Minnesota Statutes Section 115A.921 to authorize a city or town to <br />impose a fee of $.50 per cubic yard of waste or its equivalent on <br />operators of facilities for the disposal of construction debris <br />located within the city or townj and, <br /> <br />WHEREAS, <br /> <br />there is located within the City of Elk River a facility for the <br />disposal of construction debris. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City <br />of Elk River: <br /> <br />1. The fee due from an operator of a demolition debris disposal <br />facility within the City of Elk River shall, effective October 1, <br />1991, be twenty-five cents ($.25) per cubic yard of waste or its <br />equivalent, as defined in Minnesota Statutes Section 115A.921. <br /> <br />2. <br /> <br />The fee due from an operator of a demolition debris disposal <br />facility shall be paid to the City Treasurer on the 15th day of <br />each month, no later than one month after the end of the month of <br />acceptance of debris by the facility operator and disposed of on <br />land within the City. <br /> <br />e <br /> <br />3. The maximum revenue that may be collected under this subdivision <br />must be determined by multiplying the total permitted capacity of <br />a facility by 15 cents per cubic yard.
