Tralle, Mayor <br /> <br /> <br /> <br /> <br />e <br /> <br />RESOLUTION 91 - 32 <br />RESOLUTION FOR THE CITY OF ELK RIVER <br /> <br />A RESOLUTION ACCEPTING BID AND AUTHORIZING <br />EXECUTION OF CONTRACT IN THE MATTER OF THE <br />PROCTOR AVENUE IMPROVEMENT OF 1991 <br /> <br />WHEREAS, pursuant to Resolution 91-19, competitive bids were <br />solicited and received for the Proctor Avenue <br />improvement as set forth in the bid tabulation <br />attached hereto and incorporated herein by this <br />reference; and, <br /> <br />WHEREAS, the City Council has considered the amount of the bids <br />and the responsibility of the bidders and determined <br />that R.L. Larson Excavating, Inc., is the lowest <br />responsible bidder. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City <br />of Elk River, Minnesota: <br /> <br />1. <br /> <br />The Mayor and City Administrator are authorized and <br />directed to execute, on behalf of the City, such <br />contract with R.L. Larson Excavating, Inc., as is <br />approved by the City Attorney for the completion of <br />the Proctor Avenue improvement according to the <br />approved plans and specifications designated in <br />Resolution 91-19. Execution of said contract is <br />contingent on concurrence of the City's action by the <br />Sherburne County Board of Commissioners. <br /> <br />e <br /> <br />2. <br /> <br />The City Administrator is directed to relay to the <br />Sherburne County Board of Commissioners the action <br />undertaken by the City Council and request their <br />concurrence. <br /> <br />3. <br /> <br />The City Administrator is authorized and directed to <br />forthwith return to all bidders the deposits made with <br />their bids upon execution of the contract above <br />specified. <br /> <br />ATTEST: <br /> <br />e <br /> <br />
