<br />VILLAGE OF ELK RIVER COUNCIL MEETING <br />April 14, 1950 <br /> <br />A special meeting was held at the Municipal Building on April 14, 1950 at 4:00 o’clock P.M. <br /> <br />Members present: <br /> R. A. Ellingson, Mayor; Emil Parent, Dan Bailey, R.A. Ryding, Trustees; H.A. Briggs <br /> <br />Purpose of the meeting was to consider the petition for vacation of street filed at the last council <br />meeting. <br /> <br />Resolution favoring vacating street attached. <br /> <br />Meeting adjourned. <br /> <br />H.A. Briggs <br />Clerk <br /> <br />RESOLUTION OF VILLAGE COUNCIL VACATING STREET <br /> <br />In the Matter of the Vacation of a Portion of Depot Street Adjacent to Lot 3, Block 24, in the <br />Village of Elk River <br /> <br />The above entitled matter came on to be heard before the Village Council of the Village of Elk <br />River, Minnesota, upon a petition duly filed by Elmer Leger for the vacation of the following <br />described portion of Depot Street in said Village: <br /> <br />That portion of Depot Street lying between Lot Three (3), Block Twenty-four (24) in the Village of <br />Elk River, and the right-of-way of U.S. Highway No. 10, <br /> <br />And the Village Council having given due notice of said hearing by published and posted notice as <br />th <br />provided by law, and said hearing having been held on the 14 day of April, 1950, at 4:00 o’clock <br />P.M. in the Municipal Building in said Village, and no one appearing in opposition thereto, and the <br />said council after hearing the evidence presented to it in favor of said petition; that petitioner is the <br />owner of all the land abutting said portion of Depot Street, that said portion of Depot Street is not <br />now or in the foreseeable future being used for any public purpose and that it would be to the best <br />interest of the public to vacate said portion of Depot Street; <br />Councilman Dan Bailey introduced the following resolution, to-wit: That <br /> <br />That portion of Depot Street lying between Lot Three (3), Block Twenty-four (24) in the Village of <br />Elk River, and the right-of-way of U.S. Highway No. 10, be and the same is hereby vacated. <br /> <br />Which said resolution was seconded by Councilman H.A. Briggs and being put to a vote a majority <br />of said Council voted in favor of said resolution, whereup said resolution was declared adopted by <br />the President of said council. <br /> <br />Dated: At Elk River, Minnesota <br /> <br />
