<br />STATE OF MINNESOTA <br />COUNTY OF SHERBURNE <br /> <br />In the matter of the vacation of a portion of Depot Street adjacent to Lot 3, Block 24, in the Village <br />of Elk River. <br /> <br />PETITION <br /> <br />TO THE VILLAGE COUNCIL OF THE VILLAGE OF ELK RIVER: <br />Your petitioner, Elmer Leger, represents to the Village Council of the Village of Elk River, <br />Sherburne County, Minnesota, that he is the owner of all the land abutting on the following <br />described portion of Depot Street in said Village of Elk River: <br /> <br />That portion of Depot Street lying between Lot Three (3), Block Twenty-four (24) in the Village of <br />Elk River, and the right-of-way of U.S. Highway No. 10, <br /> <br />And that your petitioner believes that it would be to the best interest of the public to vacate said <br />portion of Depot Street above described, for the reason that the same is not now and for several <br />years past has not been used by the public and indications are that it will never be devoted to any <br />public purpose. <br /> <br />WHEREFORE, Your Petitioner prays that the said Village Council proceed to vacate said street so <br />described, pursuant to the provisions of Section 412.851 of Minnesota Statutes Annotated same <br />th <br />being Section 102 of Chapter 119, Laws of 1949.
