RESOLUTION 91 - 16 e RESOLUTION FOR THE CITY OF ELK RIVER A RESOLUTION RELATING TO FINDING OF PUBLIC PURPOSE FOR THE ACQUISITION OF RIGHT-OF-WAY FOR FILLMORE STREET WHEREAS, a roadway, commonly known as Fillmore Street, located within the City of Elk River has been used by the general public as a thoroughfare; and, WHEREAS. the City of Elk River has repaired and maintained Fillmore Street continuously for at least six years, the statutory term prescribed in Minnesota Statutes Section 160.05 to establish the pUblic right-of-way; and, WHEREAS, the City of Elk River directed the preparation of a feasibility study to upgrade and improve the Fillmore Street roadway between the areas of 174th Street and 181st Street and held a pUblic hearing pursuant to Minnesota Statutes Section 429 ~t_~~~~, to consider ordering improvements to Fillmore Street; and, e WHEREAS, the City Council of the City of Elk River, at its meeting of March 4, 1991, adopted Resolution 91-13, ordering the public improvement for Fillmore Street; and, WHEREAS, the City Engineer has determined the need for additional right-of-way to construct the Improvements; and, WHEREAS, the City Council of the City of Elk River has determined that the Improvements and need for additional right-of-way for roadway and bike trail are in the pUblic interest. NOW. THEREFORE, BE IT RESOLVED BY THE City Council of the City of Elk River, that the City acquire the right, title and interest in certain property generally described on the attached Exhibit A, pursuant to Minnesota Statutes Section 117 5LLJL~. for the public purpose of constructing the Improvements to Fillmore Street.
