Preliminary Plat of Tall Pines Second <br />Addition <br />Action Requested <br />The Planning Commission recommended denial of the Zone Change, <br />Conditional Use Permit, and Preliminary Plat citing: <br />1. Inconsistencies with the Comprehensive Plan <br />2. The potential to detrimentally impact the use and enjoyment of <br />other properties <br />3. A detrimental impact on the normal and orderly development of <br />the remaining vacant parcels <br />If the Council concurs with the Commission, they should direct staff <br />to prepare a resolution making findings of fact denying each <br />application, citing specific conditions or standards associated with the <br />review of each application. These standards are outlined in the staff <br />report to the Commission. The resolution and findings would be <br />considered by the council during the June 15, 2020, meeting. <br />Alternatively, if Council supports the project, the conditions outlined <br />in the attached memo to the Planning Commission should be <br />included in a motion to approve. <br />Background/Discussion <br />The applicant, Roger Derrick with the Pines at Elk River, LLC, is <br />Figure <br />proposing to develop a 6.33-acre parcel along Line Ave with 29 <br />residential townhomes on 40-foot-wide lots. The project will be like the Tall Pines subdivision just south of this <br />project on 183Td Circle also developed by Mr. Derrick. Kliever Lake Fields, West Oaks, and Miske Meadows <br />have also included detached townhome units like those proposed with this project.
