<br />VILLAGE OF ELK RIVER COUNCIL MEETING <br />November 12, 1935 <br /> <br />The special meeting of the Village Council was held at the Municipal Bldg Monday November 12, <br />1935 at 3:00 P.M. <br /> <br />Members present: <br />D.E. Davis, Pres.; J.D. Flaherty, Wm Patenaude, Trustees; <br />Wm H Greupner, Clerk. <br /> <br />R.J. Collapy, representing the Austin Western Road Machinery Co. was at this meeting to explain the <br />different kinds of snow plows. The one he recommended for Village the size of Elk River would <br />cost $295.00 delivered at Elk River. After some discussion it was decided to have the Clerk see Dan <br />Hjerpe, Village Blacksmith and see if he could make a plow of this kind and what the cost would be. <br /> <br />Frank White Village attorney attended this meeting to look over the interim ordinance pending the <br />adoption of the zoning ordinance. Mr. White advised the Council to pass such an ordinance. <br />Whereupon J.D. Flaherty made a motion seconded by Wm Greupner to pass the following <br />ordinance. <br /> <br />Ordinance No. 33 <br /> <br />An Ordinance relating to the location, size and use and arrangement of buildings on lots in the <br />Village of Elk River and for the purpose of promoting the Public Health, Safety and Convenience, <br />Property and General Welfare of the said Village and for the aforesaid purpose to divide the Village <br />into Districts. The Council of the Village of Elk River does ordain: <br /> <br />Section 1, Pending the adoption of a comprehensive zoning ordinance pursuant to Chapter 176 , <br />Laws 1929, as amended by Chapter 376, Laws of 1935, for the purpose of regulating the locating, <br />size, use and height of buildings the arrangement of buildings on lots and the density of population <br />in the Village and to provide separate districts for the purpose of carrying out the aforesaid <br />regulations no person, firm or corporation shall construct, move or extend the outside dimensions <br />of any building upon any land in the city without having received a permit with the unanimous <br />approval of the Village Council. <br /> <br />Section 2. Any person or persons violating the provisions of this ordinance by neglecting or refusing <br />to secure a permit or who proceeds upon the refusal of a permit by the Village council shall be guilty <br />of a misdemeanor and upon conviction, thereof shall be punished by a fine of not to exceed $100 or <br />by imprisonment for not to exceed three months. The continued violation of this ordinance and <br />each day such violation continues shall constitute a separate violation hereof and shall be punishable <br />as such. <br /> <br />Section 3. Every provision of this ordinance shall be separable from every other part of provision <br />thereof and if any provisions is held invalid by the court such invalidity shall not affect any other <br />park or provisions hereof. <br /> <br /> <br />
