Tralle, Mayor <br /> <br />A~ <br /> <br /> <br />. <br /> <br />RESOLUTION 92 - ~ <br />RESOLUTION FOR THE CITY OF ELK RIVER <br /> <br />A RESOLUTION FOR VACATING A PORTION OF A DRAINAGE AND <br />UTILITY EASEMENT <br /> <br />WHEREAS, a majority of the property owners abutting the <br />drainage and utility easement have requested the City <br />Council in a petition dated August 25, 1992, to vacate <br />such easement according to lawi and, <br /> <br />WHEREAS, a public hearing was held on September 21st, 1992, <br />before the City Council at the Salk School on such <br />petition after due published and posted notice had <br />been given, as well as personal notice to affected <br />property owners by the clerk on September 10, 1992, <br />and all persons interested were given an opportunity <br />to be heardi and, <br /> <br />WHEREAS, it appears that it will be in the best interest of the <br />City to approve such petition. <br /> <br />. <br /> <br />NOW, THEREFORE, BE IT RESOLVED that such petition is hereby <br />granted and the drainage utility easement described as <br />follows is hereby vacated: <br /> <br />That easement for drainage and utility purposes over, <br />across, and under the North 10 feet, as measured at <br />right angles, of Lot Ii and over, across, and under <br />the South 10 feet, as measured at right angles, of Lot <br />2i both of Block 6 of the duly recorded plat of <br />BARRINGTON PLACE, Sherburne County, Minnesota. <br />EXCEPTING therefrom the East 10 feet thereof, as <br />measured at right angles to the East line of said Lots <br />1 and 2. ALSO EXCEPTING therefrom the West 10 feet <br />thereof, as measured at right angles to the West line <br />of said Lots 1 and 2. ALSO EXCEPTING therefrom any <br />part thereof lying within those easements described in <br />Instrument No. 184397, files of the Sherburne County <br />Recorder. <br /> <br />ATTEST: <br /> <br />. <br /> <br />
