RESOLUTION 92- 17 RESOLUTION FOR THE CITY OF ELK RIVER A RESOLUTION APPROVING NOTICE OF PUBLICATION OF ORDINANCE 92-4 WHEREAS, the City of Elk River has researched the impacts of Sexually Oriented Land Uses on surrounding properties and the community in general; and WHEREAS, the findings of said research are stated in Ordinance 92-4; and, WHEREAS, it was concluded from said research that Sexually Oriented Land Uses should have specific regulations and licensing directed at them to minimize impacts from said uses on children, community goals, adjacent property values, the economic well-being of the City, criminal activity and other sex related crimes; and, WHEREAS, a pUblic hearing with due notice was held regarding this sUbject on February 24, 1992 during which the Elk River City Council received pUblic input. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the of Elk River, Minnesota, that Ordinance 92-4, passed adopted on the 2nd day of March, 1992 is summarized PUblication as follows: City and for 1. Adding definitions for specified anatomical areas, specified sexual activities and sexually oriented land uses to the Elk River City Code. 2. Adding Sexually Oriented Land Uses to the Elk River City Code in Industrial Zones as a Conditional Use. 3. Adding provision requiring Sexually Oriented Land Uses to obtain a license. 4. Adding specific regulations for Sexually Oriented Land Uses to the Elk River City Code of Ordinance on exterior storage and display, location, adult cabarets, exposure to minors, motion picture arcades, and hours of operation. A copy of the full text of the regulations regarding Sexually Oriented Land Uses is available for inspection by any person at the office of the Elk River City Clerk during normal business hours.
