<br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />RESOLUTION 93 - 31 <br />RESOLUTION FOR THE CITY OF ELK RIVER <br /> <br />A RESOLUTION FOR VACATING DRAINAGE EASEMENT <br /> <br />WHEREAS, a majority of the property owners abutting the <br />drainage easement have requested the City Council in a <br />petition dated May 25, 1993, to vacate such easement <br />according to law; and, <br /> <br />WHEREAS, a public hearing was held on June 21, 1993, before the <br />City Council at the Elk River City Hall on such <br />petition after due published and posted notice had <br />been given as well as personal notice to affected <br />property owners on June 7, 1993, and all persons <br />interested were given an opportunity to be heard; and, <br /> <br />WHEREAS, it appears that it will be in the best interest of the <br />City to approve such petition. <br /> <br />NOW, THEREFORE, BE IT RESOLVED that such petition is hereby <br />granted and the drainage easement described as follows <br />is hereby vacated: <br /> <br />Commencing at the point of intersection of the existing <br />easement and the right-of-way line of 202nd Avenue NW, said <br />point being 199.31 feet southwesterly of the easterly most <br />corner of Lot 4, Block 2, MEADOWVALE WOODS, as measured along <br />said right-of-way; thence North 54 degrees 49 minutes 41 <br />seconds West along said existing easement a distance of 125.00 <br />feet to the point of beginning of the land to be described, <br />said point is referred to as point A; thence continuing North <br />54 degrees 49 minutes 41 seconds West a distance of 63.00 feet; <br />thence North 35 degrees 10 minutes 19 seconds East a distance <br />of 42.00 feet; thence South 54 degrees 49 minutes 41 seconds <br />East a distance of 40.45 feet to a point on the said existing <br />easement line; thence South 6 degrees 56 minutes 32 seconds <br />West along said easement line a distance of 47.67 feet to the <br />point of beginning. <br /> <br />Adopted by the Elk River City <br />JUNE , 1993. <br /> <br />21 <br /> <br />of <br /> <br /> <br />ATTEST: <br /> <br />
