<br />e <br /> <br />RESOLUTION 94- 120 <br /> <br />A RESOLUTION FOR THE CITY OF ELK RIVER <br />RELATING TO THE SOLID WASTE FEE STUDY <br />BY THE MINNESOTA OFFICE OF ENVIRONMENTAL ASSISTANCE <br /> <br />WHEREAS, Minnesota Statute Section 115A.921 allows cities to use seventy- <br />five percent (75%) of the surcharge monies collected from landfills <br />for general fund purposes; and <br /> <br />WHEREAS, the City of Elk River, in reliance on this Statute, has obligated these <br />monies for future payments on public buildings; and, <br /> <br />WHEREAS, the City Council of the City of Elk River feels it is appropriate that <br />the current portion of landfill surcharge monies that are allowed for <br />general fund purposes continue to be used to help offset negative <br />affects of having a landfill located in the community; and, <br /> <br />e <br /> <br />WHEREAS, the Elk River City Council has reviewed the Minnesota Office of <br />Environmental Assistance (OEA) Solid Waste Fee Report, which <br />includes a recommendation that all landfill surcharge monies <br />collected by cities be used only for solid waste activities. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk <br />River that the City of Elk River is in strong opposition to OEA's <br />recommendation to eliminate landfill surcharge monies from going <br />to general fund purposes. <br /> <br />Passed and adopted by the Elk River City Council this 21 st day of November, <br />1994. <br /> <br />ATTEST: <br /> <br /> <br />-<:i,r,."~ _>_ <br /> <br /> <br />Sandra A.
