e RESOLUTION 94-109 A RESOLUTION FOR THE CITY OF ELK RIVER A RESOLUTION REQUESTING THE OTSEGO CITY COUNCIL TO CONSIDER ADOPTING AN ORDINANCE TO REGULATE HUNTING ON CERTAIN AREAS OF THE MISSISSIPPI RIVER WHEREAS, the City of Elk River ordinance bans hunting and the discharge of dangerous weapons on the Elk River side of the Mississippi River; and WHEREAS, the City of Otsego currently has no ordinance banning hunting or the discharge of dangerous weapons on the Mississippi River; and e WHEREAS, for the past several years the Elk River Police Department has received numerous complaints in regard to hunting on the Mississippi ;River near downtown ~lk River; and WHEREAS, complaints relating to hunting and the discharge of firearms are mainly near the downtown area, at a location where the Elk River enters the Mississippi River easterly to Highway 101; and WHEREAS, due to the close proximity of the Mississippi River to downtown Elk River, hunting and/or discharging of dangerous weapons in this area could be harmful; and WHEREAS, because the hunting is taking place on the Otsego side of the Mississippi River, the City of Elk River has no jurisdiction over the situation. e NOW, THEREFORE, BE IT RESOLVED that in order to control the possibility of harm due to the discharge of firearms on the Mississippi River near the Elk River downtown area, the City Council requests the City of Otsego to consider the adoption of an ordinance to regulate the hunting and/or discharge of dangerous weapons on the Mississippi River from the eastern border of Otsego Park, easterly to Minnesota State Highway 101.
