Request for Action <br />City of <br />Elk <br />River <br />To <br />Item Number <br />Mayor and City Council <br />9.2 <br />Agenda Section <br />Meeting Date <br />Prepared by <br />Work Session <br />January 21, 2020 <br />Zack Carlton, Planning Manager <br />Item Description <br />Reviewed by <br />Religious and Educational Uses in FAST — The <br />Point Zoning District <br />Cal Portner, City Administrator <br />Reviewed by <br />Action Requested <br />Provide staff direction regarding a possible amendment to the city's zoning ordinance. <br />Background/Discussion <br />During the spring of 2019, Council directed staff to separate "Institutional Uses" into separate uses — <br />Religious Uses, Educational Uses, Residential Treatment Facilities, and other health care uses. Each of <br />these uses were then reviewed separately for inclusion into the city's various zoning districts. Placement <br />of the new uses were reviewed by the Planning Commission and City Council, and the ordinance <br />amendment was adopted by the City Council on August 19, 2019. <br />The adopted ordinance does not allow religious or educational uses in the FAST — The Point (Saxon area) <br />zoning district. These uses had previously been allowed in the district under the larger "Institutional Use" <br />designation prior to adoption of the amendment. In reviewing the records for the amendment process <br />these uses had not been allowed in the district under any draft. <br />Religious and educational uses are allowed in all straight residential districts (R1, R2b, R3, etc.) but are not <br />allowed in the two districts that allow a mix of commercial and residential uses (Downtown and FAST — <br />The Point). The only impact to existing uses in either of these districts was to Elk River Lutheran Church <br />in Downtown.
