<br />. <br /> <br />. <br /> <br />. <br /> <br />CITY OF ELK RIVER <br /> <br />RESOLUTION NO. 05-70 <br /> <br />A RESOLUTION AMENDING THE COMPREHENSIVE PLAN <br />TO CHANGE THE LAND USE FROM DR (URBAN RESIDENTIAL) TO HB <br />(HIGHWAY BUSINESS) <br /> <br />Case No. LU 05-02 <br /> <br />WHEREAS, Minnesota Statutes, Chapter 462.355, Subdivision 2, prescribes the procedure <br />for amending the Comprehensive Plan, and <br /> <br />WHEREAS, the Planning Commission held a public hearing on Tuesday, May 24, 2005 and <br />recommended approval regarding the Comprehensive Plan amendment request for the property <br />generally described as: <br /> <br />Lot 1, Block 1, Zylstra Addition, <br />Sherburne County, Minnesota <br /> <br />and, <br /> <br />WHEREAS, the City Council has reviewed the Comprehensive Plan amendment request <br />and finds the following: <br /> <br />1. The proposed amendment would eliminate a situation where a parcel has a split land use <br />designation. <br />2. The proposed amendment is appropriate for this site because the majority of the property <br />has a land use designation of HB. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Gty Council of the Gty of Elk River <br />that the Land Use Plan be amended to change the property as described above from UR (Urban <br />Residential) to HB (Highway Business), with the conditions that a 50 (fifty) foot vegetation buffer be <br />maintained on the property along the adjacent residential developments. <br /> <br />PASSED by the City Council of the City of Elk River this 20th day of June, 2005. <br /> <br />ATTEST: <br /> <br />~;~ <br /> <br />J~e <br />
