<br />e <br /> <br />RESOLUTION NO. 94 - lL <br />A RESOLUTION OF THE CITY OF ELK RIVER <br /> <br />A RESOLUTION REQUESTING VARIANCES FROM MINNESOTA DEPARTMENT <br />OF TRANSPORTATION RULES FOR STATE AID OPERATIONS TO ALLOW <br />RECONSTRUCTION OF JACKSON AVENUE USING MUNICIPAL STATE <br />AID TURNBACK FUNDS. <br /> <br />WHEREAS, the segment of Jackson Avenue from Trunk Highway 10 to Trunk Highway <br />169 was reverted from TH 201 (old 169) to the City of Elk River's <br />Municipal State Aid System in September 1987, and <br /> <br />WHEREAS, the segment of Jackson Avenue from TH 10 to School Street was <br />reconstructed to a 44 foot urban section in 1988, and <br /> <br />WHEREAS, the segment of Jackson Avenue from School Street to TH 169 was overlaid <br />as a temporary measure to improve the driving surface at that time in 1988, <br />and <br /> <br />e <br /> <br />WHEREAS, the City understood in 1988 that Municipal State Aid Turnback Funds could <br />be utilized in the turnback, 1987 to 1997, to further reconstruct Jackson <br />Avenue from School Street to TH 169 once development of the adjacent area <br />occured, and <br /> <br />WHEREAS, the City of Elk River has plans to reconstruct Jackson Avenue from School <br />Street to Trunk Highway 169 by lowering the rural road section and <br />constructing an urban road section to meet the growing needs of the <br />community, and <br /> <br />WHEREAS, this improvement does not meet the Minnesota Department of Transportation <br />rules for State Aid Operations, Chapter 8820.2900; <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, <br />Minnesota: <br /> <br />1. That the City requests a variance from Minnesota Department of Transportation's, <br />State Aid Operations Rules, Chapter 8820.2900, to allow the use of Municipal State <br />Aid Turnback Funds for the reconstruction of Jackson Avenue from School Street <br />to Trunk Highway 169. <br /> <br />e <br /> <br />216-1501.feb <br />
