of ver Councilmember Wagner adoption: introduced the following resolution and moved its Resolution 19- 53 A Resolution of the City of Elk River Approving Notice of Summary Publication of Ordinance # 19--1.9 An Ordinance Granting a Franchise to Spectrum Mid -America LLC d/b/a Charter Communications WHEREAS, on February 4, 2019, the Elk River City Council adopted Ordinance 19-02 repealing and replacing an ordinance titled the "Cable Ordinance" which established regulations governing cable service; and WHEREAS, the City Council adopted a lengthy ordinance granting a 15-year renewal of the cable franchise to Spectrum Mid -America LLC d/b/a Charter Communications which authorizes operation of a cable system and delivery of cable services in the city pursuant to the Cable Ordinance; and WHEREAS, as authorized by Minnesota Statutes, Section 412.191, subd. 4, the City Council has determined that publication of the title and summary of the ordinance will clearly inform the public of the intent and effect of the ordinances; and WHEREAS, a copy of the full text of the ordinance is available for inspection by any person at the office of the Elk River City Clerk, 13065 Orono Parkway, during regular business hours; and NOW, THEREFORE, BE IT RESOLVED by the City Council, by at least four -fifths vote, authorizes the publication of the title and summary of Ordinance 19- 19 The motion for adoption of the foregoing resolution was duly seconded by Councilmember Ovai1 , and upon vote being taken thereon, the following voted in favor thereof: Mayor Dietz, Uouncilmembers Christianson, Westgaard, Uvall, and Wagner and the following against: none , whereupon said resolution was declared duly passed and adopted.
