I <br />understand that the plans are to widen Upland Ave and add a sidewalk on the west side of <br />the street. <br /> <br />Please be advised that the plan involves the use of my private property over which the <br />City of Elk River has no easement for right of way purposes. The city proposes to use <br />privately owned land for the completion ofthe project without justification. <br /> <br />According to a recent survey performed in 2002 by John Oliver and Associates the City <br />of Elk River has already encroached upon my property at 441 Upland Ave NW. At this <br />point in time, I will not allow any further encroachment on the property due to widening <br />the road or the addition of a sidewalk. I am willing to discuss this matter with you. <br />Hopefully, we will be able to resolve this in a timely manner. <br /> <br />Thank you for taking the time to review the attachments and the letter.
