Elk River <br />Municipal Utilities <br />TO: <br />ERMU Commission <br />MEETING DATE: <br />August 13, 2019 <br />SUBJECT: <br />UTILITIES COMMISSION MEETING <br />FROM: <br />Jennie Nelson — Customer Service Manager <br />AGENDA ITEM NUMBER: <br />6.2 <br />The City of Dayton Franchise Ordinance <br />ACTION REQUESTED: <br />None. <br />BACKGROUND: <br />The City of Dayton is proposing an Electric Service Franchise Fee Ordinance, similar to the City <br />of Elk River, which would require ERMU to bill franchise fees on behalf of the city to its <br />customers in Dayton. In that planning process, the City of Dayton learned that there is not an <br />Electric Franchise Ordinance on file for ERMU, which is needed to implement the Electric <br />Service Franchise Fee Ordinance. <br />DISCUSSION: <br />The City of Dayton has drafted an Electric Franchise Ordinance, which will be brought to their <br />City Council on August 27, and an Electric Service Franchise Fee Ordinance that will be brought <br />to their City Council in September. Our attorney has reviewed both of the documents and has <br />some minor language revisions he would like to apply to the Electric Franchise Ordinance. He is <br />working directly with the City of Dayton's attorney's office. We will bring the final language <br />back to the Commission in September for acceptance. <br />Page 1 of 1 <br />128 <br />
