RESOLUTION NO. 19-5 <br /> BOARD OF COMMISSIONERS <br /> ELK RIVER MUNICIPAL UTILITIES <br /> A RESOLUTION ADOPTING THE ELK RIVER MUNICIPAL UTILITIES COGENERATION AND SMALL <br /> POWER PRODUCTION TARIFF,WHICH INCLUDES THE DISTRIBUTED ENERGY RESOURCE <br /> INTERCONNECTION PROCESS. <br /> WHEREAS, by order on September 28, 2004,the Minnesota Public Utilities Commission <br /> adopted Generic Standards for Utility Tariffs for Interconnection and Operation of Distributed <br /> Generation Facilities; and <br /> WHEREAS, Minnesota Statutes Section 216B.1611, subdivision 3 required municipal utilities to <br /> adopt a generation tariff that addressed the issues included in the commission's order; and <br /> WHEREAS, under Minnesota Statutes Section 216B.25, any order of the commission <br /> rescinding, altering, amending, or reopening a prior order shall have the same effect as an <br /> original order; and <br /> WHEREAS, by order on August 13, 2018, the Minnesota Public Utilities Commission adopted <br /> an updated interconnection process for distributed energy resources replacing the standards <br /> adopted in 2004; and <br /> WHEREAS,the Elk River Municipal Utilities Distributed Energy Resource Interconnection <br /> Process addresses the issues included in the commission's 2018 order; and <br /> WHEREAS,this Distributed Energy Resource Interconnection Process functions in concert with <br /> the Elk River Municipal Utilities Policy Regarding Distributed Energy Resources and Net <br /> Metering as well as its Rules Governing the Interconnection of Cogeneration and Small Power <br /> Production; <br /> THEREFORE, BE IT RESOLVED that the Elk River Municipal Utilities Commission adopts the <br /> attached ERMU Policy—E.12b—Cogeneration and Small Power Production Tariff, which <br /> includes the Distributed Energy Resources Interconnection Process. <br /> This Resolution Passed and Adopted this 14th day of May, 2019. <br /> J n J.
