PUD, Case No. CU 19-01 <br /> <br /> <br />Action Requested <br />Recommend, by motion, approval of the Conditional Use Permit to amend the approved site plan for the <br />nd <br />Hillside Crossing 2 Addition Planned Unit Development. <br /> <br />Background/Discussion <br />The property is zoned Planned Unit Development (PUD) where amendments to a PUD agreement <br />require a Conditional Use Permit (CUP). The applicant is seeking a CUP to amend the approved PUD <br />development plan to add an automated express lane for online order pickup. <br /> <br />The applicant is requesting the PUD agreement be amended to allow for a four-foot setback along the <br />north property line of the subject parcel to allow the construction of the proposed drive lane, retaining <br />wall, and fence/barrier wall. <br /> <br />Staff has no concerns with this request and only supports the drive lane, retaining wall, and fence/barrier <br />wall being setback as shown on the site plan. No building structure, other than the covered drive-thru, <br />can be located closer to the north property line than what is currently constructed on site. <br /> <br />Applicable Regulation <br />In approving a Conditional Use Permit, the Planning Commission and City Council may impose such <br />specific conditions with regard to the development or operation of the proposed use as it considers <br />necessary to satisfy the seven standards set forth in Section 30-654 in order to promote compatibility <br />with and minimize any potentially adverse effects upon adjacent properties, the neighborhood or the city. <br /> <br />The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location: <br /> <br />1.
