EGty1 ,., Request for Action
River
To Item Number
Mayor and City Council 7.3
Agenda Section Meeting Date Prepared by
Public Hearin s March 18, 2019 Chris Leeseber , Senior Planner
Item Description Reviewed by
Ordinance Amendment: Temporary Signs Zack Carlton,Planning Manager
Reviewed by
Cal Portner, City Administrator
Action Requested
Adopt,by motion, an ordinance amending City Code Section 30-867, district regulations.
Background/Discussion
While the City Council removed the deposit fee requirement for temporary signs, Section 30-867 still
states a deposit is required. The Planning Commission recommended the deposit language be removed.
The Commission also recommends amending where temporary signs may be located. Currently,
temporary signs are only allowed on approved surfaces (concrete, asphalt, Class 5). In some cases,
approved surfaces are setback much farther than 10-feet, the standard parking lot setback. In order to
treat all businesses and residents equally, the Commission recommends adding the following language:
If an approved surface is not located in a frontyard oris more than 70 feet from the frontproperty line, the sign may be
located in a landscaped area and shall be setback 10 feet from propeiy lines. The landscaped area around the temporary
sign must continue to be maintained P)hile the sign is in place.
Additionally, to help reduce the saturation of temporary signage, staff recommended when a non-profit
sign is installed for longer than 14 days,it shall count toward that property's 90-day limit for temporary
signage, the ordinance currently allows 30 days for temporary signs. The Commission and the Chamber
of Commerce Executive Director expressed concerns with the duration changes for non-profit temporary
signage and recommends maintaining the 30-day limit.
The attached ordinance amendment reflects the recommendations from the Planning Commission.
Planning Commission Meeting
Staff has not received any comments since the Commission meeting. The Commission unanimously
recommended approval of the request.
Attachments
■ Ordinance Amendment
The Elk River Vision
A PehoMing community Pith revolutionary and spirited resourcefulness, exceptional POWERED By
service, and community engagement that encourages and inspires prosperity INAWRE1
