410Item #6.5 <br /> City of <br /> Elk <br /> River <br /> MEMORANDUM <br /> TO: Planning Commission <br /> FROM: Chris Leeseberg, Planner <br /> DATE: July 22, 2003 <br /> SUBJECT: Request by the City of Elk River for an Ordinance Amendment, <br /> Amending Chapter 30, "Land Development Regulations", to <br /> Establish a Downtown Development District and Standards <br /> Request <br /> The Planning Commission is asked to consider an amendment to Chapter 30 "Land <br /> • Development Regulation",to establish a Downtown Development District and Standards. <br /> Attachments <br /> • Area of Proposed District <br /> • Proposed Definitions <br /> • Proposed Ordinance Language <br /> • HRA Minutes (2) sets <br /> Overview <br /> At the February 25, 2003 Planning Commission meeting,the commission recommended <br /> approval of the language pertaining to the standards for the Downtown District. <br /> Since that meeting, staff has presented the standards to the HRA twice and has made some <br /> revisions to the standards. The major change is that many areas have been divided into <br /> standards (which must be met) and guidelines (which are suggestions to meet the intent). <br /> This was in an attempt to make the district less restrictive. <br /> An area of"process" was also added to help clarify how Permitted Uses,Conditional Uses <br /> and permits for renovation/remodeling will be processed. It also clarifies how an appeal can <br /> be completed if staff concludes that the standards and/or intent are not met. <br /> • <br />
