ITEMS 5. 1. & 5.2. <br /> • ii <br /> City of ' <br /> Elk <br /> River <br /> MEMORANDUM <br /> TO: Planning Commission <br /> FROM: Stephen Rohlf, Building and Environmental Administrator <br /> DATE: April 22, 2003 Sk <br /> SUBJECT: Conditional Use Permit Request by Roger Schmidt for Mineral <br /> Excavation—CU 03-02/P.H. and Associated Zone Change Request to <br /> Mineral Excavation Overlay Zoning District ZC 03-01/P.H. <br /> Roger Schmidt agreed to have his mining request tabled while he attempted to find <br /> alternative access to Elk River Bituminous for the product he proposes to mine from the <br /> IIIsite in question. Apparently he has been successful in negotiating an easement across <br /> property owned by Aggregate Industries, avoiding the issue of truck traffic from his <br /> mining operation using US Trunk Highway 169 as a haul road, which was the major <br /> concern during the Planning Commission's review of this request. With this issue <br /> resolved, the Schmidt mining request is back in front of the Planning Commission in the <br /> hope of reversing their recommendation of denial. <br /> A. Request <br /> Roger Schmidt is requesting a conditional use permit to mine 14.81 acres of a 66.06 acre <br /> site. A zone change to Mineral Excavation Overlay Zoning District is also required. The <br /> Elk River City Council has already reviewed a discretionary Environmental Assessment <br /> Worksheet (EAW) for the project and made a negative declaration on the need for an <br /> Environmental Impact Statement. The subject property is legally described as NW 1/4 of <br /> NE 1/4, the N %2 of NW 1/4 of the NE '/4, and the North 200 feet of the NE 1/4., all in <br /> Section 10, T33 North, R26 West, Sherburne County, Minnesota. <br /> B.
