The meeting was called to order at 7:30 p.m. by Mayor Hinkle. <br /> <br />2 . Agenda <br /> <br />Item 21-b, Downtown Park, was substituted for Noxious Weed Program, an<;l Item 21-f, <br />Open Meeting Policy, was added to the July 19, 1982 City Council Agenda. <br /> <br />COUNCILMAN SCHULDT MOVED TO APPROVE THE JULY 19, 1982 CITY COUNCIL AGENDA AS AMENDED. <br />COUNCILMAN ENGSTROM SECONDED THE MOTION. . THE MOTION PASSED 4-0. <br /> <br />3 . Minutes <br /> <br />COUNCILMAN DUITSMAN MOVED TO APPROVE THE MINUTES OF THE JULY 12, 1982 CITY COUNCIL <br />MEETING. COUNCILMAN.SCHULDT.SECONDED.THE.MOTION. THE.MOTION.PASSED 4-0. <br /> <br />4. Open Mike <br /> <br />Mr. William Greene, of 17925 227th Avenue Northwest, appeared before the City <br />Council regarding the maintenance of 227th Avenue. Mr. Greene indicated that <br />227th gets very muddy after a rain and makes it very difficult for travel, and <br />further indicated that there is about !.z; mile of low spots that need to be repaired. <br />Mr. Bob Malsom, 13909 227th Avenue Northwest, indicated that there is a culvert <br />in 227th Avenue that has separated and that the road has washed out which there- <br />fore has caused him a tire blowout. The City Administrator indicated that he <br />has discussed the problem of 227th Avenue with the Street Superintendent and <br />further indicated that the Street Department could possibly fill the low spots <br />and then create a base of cinders along that section of 227th with a layer of <br />Class 5 over the cinders to prevent the dust problem. It was the general con- <br />sensus of the City Council to authorize the Street Superintendent, Ken Nelson, <br />to proceed with the repairs and maintenance of 227th with the process of a base <br />of cinders and a layer of Class 5 over th~ cinders. <br /> <br />Mr. Bob Fritz appeared before the City CO~p.ci1 regarding the .interest rate pro- <br />posed to be paid for the overpaid assessments in the Peterson Addition. Mr. <br />Fritz indicated that is.was his belief th~t the District Court determines the <br />interest to be paid on judgements. The C~ty Administrator indicated that the <br />City's attorney has indicated that the in~erest rate due on the Peterson Ad- <br />dition overpaid assessments would be six (6) percent, according to State Statute. <br />The City Administrator further indicated that the Statute Mr. Fritz was referring <br />to was regarding verdicts and judgments, aind that the amount to be refunded is on <br />overpayment of assessments. <br /> <br />It was the general consensus of the City qouncil that the City's attorney provide a <br />written opinion to the City Council regardiing the ;interest rate to be paid on <br />the overpaid assessments in the Peterson ~ddition. <br />
