r ITEM 9 <br /> .`/ - ( <br /> icyfiver <br /> f ::: ::: <br /> IFROM: ZONING ASSISTANT <br /> DATE: JANUARY 12, 1993 <br /> SUBJECT: ORDINANCE AMENDMENT REQUEST BY <br /> THE CITY OF ELK RIVER, SECTION <br /> 900. 12 "PERMITTED ACCESSORY AND <br /> CONDITIONAL USES BY DISTRICT"/ <br /> PUBLIC HEARING <br /> The City is initiating ordinance amendment proceedings to amend <br /> Section 900 . 12 ( 10) (c) ( 14) of the Elk River City Code. The <br /> proposed amendment would allow produce markets to locate in the <br /> Cl Central Commercial zoning district as a conditional use. <br /> This item was brought before the Planning Commission during an <br /> update of the proposed Farmers Market. Two tentative sites <br /> have been chosen by the Farmers Market including a downtown <br /> site in the parking lot located behind Johnson' s Department <br /> Store. Present zoning regulations do not allow produce markets <br /> in the Cl zoning district. However, it was the general <br /> consensus of the Planning Commission this type of use would be <br /> • appropriate in the downtown area. Further, it was noted that a <br /> conditional use permit should be required to address issues <br /> such as parking, traffic, and signage on a case by case basis . <br /> Staff research of area communities revealed a variety of ways <br /> to regulate farmers markets : <br /> 1 . The cities of Anoka and Andover, require farmers <br /> markets to receive a transient merchant license. In <br /> both cases, the farmers markets were located on <br /> private property. <br /> 2 . The City of Blaine does not regulate farmers markets <br /> through the zoning ordinance nor is a transient <br /> merchant license required. Blaine has indicated that <br /> they have not had any problems with farmers markets <br /> and, therefore, have no need to draft regulations <br /> regarding them. <br /> 3 . The City of Brooklyn Park has a farmers market <br /> located on a City owned athletic complex which is <br /> regulated by the Parks Department. Permit guidelines <br /> are reviewed on a yearly basis with vendors .
