C of <br />Resolution 17-_2() <br />A Resolution of the City of Elk River to Quit Claim a Portion of a Vacated <br />Right -of -Way <br />WHEREAS, Pipe Portfolio Owner (Multi) LP, a Delaware limited partnership, ("Owner") <br />is the fee owner of real property legally described in Exhibit A ("Owner <br />Parcel'); and <br />WHEREAS, on June 20, 2016, the City Council agreed to vacate three rights-of-way no <br />longer needed for public travel; and <br />WHEREAS, to give effect to the vacation of a portion of one of the rights-of-way, it is <br />necessary to execute and deliver a quit claim deed to that portion of the right <br />of way; and <br />WHEREAS, it appears that it is in the public interest to execute and deliver the quit claim <br />deed; <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk <br />River, Minnesota, as follows: <br />1. The quit claim deed attached as Exhibit B to this resolution is hereby approved and <br />the Mayor and City Clerk are hereby authorized to execute and deliver the quit claim <br />deed upon the owner of the underlying Property granting replacement easements for <br />the vacated rights-of-way approved by the city both in form and legal description <br />Passed and adopted this 17`" day of April 2017. <br />ATTEST;, <br />Tina Allard, City -`Clerk <br />eorteE``e!' et <br />
