EGty1 ,., Request for Action
River
To Item Number
Mayor and City Council 4.9
Agenda Section Meeting Date Prepared by
ConsentJune 6, 2016 Amanda Othoudt,EDD
Item Description Reviewed by
Joplin Property Condemnation Action Cal Portner, City Administrator
Reviewed by
Action Requested
Adopt,by motion, a resolution authorizing condemnation of Parcel 1 and Parcel 3A located at the
intersection of Highway 10 and Joplin Street.
Background/Discussion
Staff is seeking authorization,by resolution, to proceed with condemnation action for two parcels located
at the intersection of Highway 10 and Joplin Street. Nagell Appraisal,Inc. completed an appraisal on both
of the remnant parcels. Parcel 1 and Parcel 3A have a combined value of$30,000.
Parcel 1 is owned by the heirs of the Lakoduk's and the Wingness's. Parcel 3A (North 33 feet of Old
Highway 10) is owned by Charles E.Johnson, who obtained title in 1909. Presumably Mr.Johnson is also
no longer alive and the title evidence suggests that this property was not conveyed through a probated
estate.
The potential heirs we have identified will receive notice of the condemnation action, but their only
interest should be in the compensation amount. If they think our appraised amount is too low, they can
present their argument to the land commissioners. If in the event, a potential heir would come forward to
claim an interest in the property, the city could enter into an agreement with the heir to compensate them
in exchange for the quitclaim deed which would extinguish any interest that she/he may have.
Financial Impact
N/A
Attachments
■ Resolution
■ Property Appraisal Report by Nagell Appraisal,Inc.
■ Parcel Diagram
POWERED 6T
AR
