EGty1� ,.,�� Request for Action <br /> River <br /> To Item Number <br /> Mayor and City Council 10.2 <br /> Agenda Section Meeting Date Prepared by <br /> Work Session May 2, 2016 Amanda Othoudt,EDD <br /> Item Description Reviewed by <br /> Joplin Property Acquisition and Condemnation Cal Portner, City Administrator <br /> Process Reviewed by <br /> Action Requested <br /> Receive an update on the progress of the Joplin Property acquisition and receive information regarding <br /> potential condemnation action. <br /> Background/Discussion <br /> Staff continues to work with our attorneys to secure interest in the property owned by the heirs of the <br /> Lakoduk's and the Wingness's in addition to the North 33 feet of Old Hwy 10 <br /> Challenges in securing interest from the many potential heirs, most of whom have little or no knowledge <br /> of the property which was formerly road right of way,has resulted in the consideration of proceeding <br /> with a condemnation action. Our representing attorney will provide background information regarding <br /> condemnation of property considered as statutorily abandoned. The heirs will still receive notice of the <br /> condemnation action,but their only interest should be in the compensation amount. <br /> The parcels being considered are parcel 1, owned by the heirs of the Lakoduk's and the Wingness's in <br /> addition to the North 33 feet of Old Highway 10 which was originally thought to be owned by the <br /> county. Per Commercial Partners Title, Parcel 3A, the north half of old Hwy 10,is owned by Charles E <br /> Johnson,who obtained title in 1909. Presumably Mr.Johnson is also no longer alive and the title <br /> evidence suggests that this property was not conveyed through a probated estate. <br /> The first step in this process is to obtain an appraisal for both parcels.
