Elk River <br /> Municipal Utilities UTILITIES COMMISSION MEETING <br /> TO: FROM: <br /> Elk River Municipal Utilities Commission Eric Volk- Water Superintendent <br /> John Dietz—Chair <br /> Al Nadeau—Vice Chair <br /> Daryl Thompson—Trustee <br /> MEETING DATE: AGENDA ITEM NUMBER: <br /> April 12, 2016 2.7 <br /> SUBJECT: <br /> Verizon Non-Exclusive Tower Attachment Lease Agreement and Memorandum of Tower <br /> Attachment Lease Agreement for the Auburn Street Water Tower <br /> BACKGROUND: <br /> At the March 17, 2016, commission meeting the Verizon Non-Exclusive Tower Attachment <br /> Lease Agreement and Memorandum of Tower Attachment Lease Agreement for the Auburn <br /> Street Tower were approved. <br /> DISCUSSION: <br /> After returning the signed and notarized documents, staff was notified by Verizon <br /> representatives that further clarification needed to be made to the first"Whereas"recital on the <br /> lease agreement. It has now been updated to clarify that the Auburn Street water tower is on <br /> property owned by the City of Elk River,but that Elk River Municipal Utilities has the ability to <br /> enter into the lease agreements for use of the property/water tower. Fortunately, the revised <br /> language is consistent with what was stated on the Gary Street water tower lease agreement.
