FIRST AMENDMENT TO CONTRACT FOR <br /> 111 PRIVATE DEVELOPMENT <br /> THIS FIRST AMENDMENT TO CONTRACT FOR PRIVATE DEVELOPMENT is <br /> made and entered into this day of January, 1995, by and <br /> between ECONOMIC DEVELOPMENT AUTHORITY FOR THE CITY OF ELK RIVER <br /> ("EDA") and TESCOM CORPORATION, a Minnesota corporation <br /> ("Tescom") . <br /> RECITALS: <br /> FIRST: EDA and Tescom entered into that certain Contract for <br /> Private Development dated May 18, 1993 ("Contract") , <br /> regarding the property legally described as Lots 2 and <br /> 3, Block 2, Elk River Industrial Park 2nd Addition, <br /> Sherburne County, Minnesota. <br /> SECOND: EDA and Tescom desire to amend the Contract as set <br /> forth below. <br /> NOW, THEREFORE, in consideration of Ten and 00/100 Dollars <br /> ($10. 00) and for other good and valuable consideration, the <br /> receipt and sufficiency of which is hereby acknowledged, EDA and <br /> Tescom agree that the Contract shall be amended as follows: <br /> 1. Schedule A of the Contract is hereby amended in its <br /> 111 entirety as follows : <br /> SCHEDULE A <br /> Description of Development Property <br /> Lot 1, Block 2, Elk River Industrial Park 2nd Addition, Sherburne <br /> County, Minnesota; <br /> Lot 2, Block 2, Elk River Industrial Park 2nd Addition, Sherburne <br /> County, Minnesota; and <br /> Lot 3, Block 2, Elk River Industrial Park 2nd Addition, Sherburne <br /> County, Minnesota. <br /> 2 . Except as hereby modified and amended, all other terms, <br /> covenants and conditions of the Contract shall continue in full <br /> force and effect without change. <br /> IN WITNESS WHEREOF, the parties have executed this First <br /> Amendment to Contract for Private Development on the day and year <br /> first above written. <br />
