EGty1 ,., Request for Action
River
To Item Number
Mayor and City Council 7.1
Agenda Section Meeting Date Prepared by
Public Hearin ISeptember 21, 2015 Chris Leeseber , Senior Planner
Item Description Reviewed by
Ordinance Amendment Regarding Accessory Zack Carlton,Planning Manager
Dwelling Units Reviewed by
Action Requested
Adopt,by ordinance, the proposed amendment to Section 30-991 regarding accessory dwelling units.
Background/Discussion
The council reviewed and discussed the information from the responding communities at their July 20,
2015, meeting and the consensus was to allow Accessory Dwelling Units (ADU's) either as attached or
detached structures.
Using language and information gathered from the other communities, staff drafted the proposed
language in the attached ordinance amendment. The city attorney and Planning Commission have
reviewed the amendment.
Planning Commission
The Planning Commission did not have any concerns with the amendment, but wanted clarification when
a rental license would be required, specifically if a basement was set up for a relative that needed
assistance.
A license would be required only if it is rented. Section 30-191 states:
No person shall operate a rental A)elling in the city P)ithout having first obtained a license for that Arelling
unitfrom om the fire chief.
There was discussion if a basement, being used by someone, only has bedrooms and bathrooms but no
kitchen area. A household that shares a cooking facility does not meet the definition of an ADU and is
not considered a separate dwelling unit in that case.
The Planning Commission unanimously recommended approval of the request.
Financial Impact
None
Attachments
■ Planning Commission Memo dated August 25, 2015
■ Ordinance
POWERED 6T
Template Updoted 4/14 INAWRE1
