Conditional Use Permit Cal Portner, City Administrator <br /> Revocation Reviewed by <br /> Action Requested <br /> Receive additional testimony and determine compliance with Conditional Use Permit (CUP) CU 06-12 <br /> permitting the operation of a high performance automobile garage at 16820 Highway 10. <br /> • If the City Council determines the operation does not comply with the CUP, staff will prepare a <br /> Findings of Fact regarding revocation of the CUP for consideration during the August 17, 2015, <br /> Council meeting. Specific reasons for the revocation must be stated. <br /> • If it is determined the operation is in full compliance with the CUP,no further action is required. <br /> • The City Council may also continue the Public Hearing to a future date. <br /> Background/Discussion <br /> The City Council held a Public Hearing on July 6, 2015, to discuss the revocation of CU 06-12 <br /> authorizing the operation of a high performance automobile shop. During the meeting, staff reviewed <br /> noise readings taken at various points around the property and how the measurements compared to <br /> environmental sources. The review identified specific noise concerns with the process of moving <br /> vehicles from the garage/shop area in the west half of the building to the dyno cell to the east. There are <br /> not any external noise reducing measures and readings taken during this process were some of the <br /> highest recorded on site. <br /> The owner of HiTech Motorsports, Bart Wells, spoke about the results and offered a number of <br /> solutions,including backing the vehicles out of the garage in a different direction or towing them around <br /> the building so they are not started near the residential properties. He also addressed questions regarding <br /> his hours of operation and offered to install a fence to block the back half of the lot to prevent anyone <br /> from working after hours. Mr. Wells requested additional time to look into the costs and evaluate the <br /> effectiveness of some of the operational changes. <br /> The City Council granted the request and continued the public hearing to the August 3, 2015, meeting. <br /> Staff was directed to complete additional noise testing after Mr. Wells had completed additional research <br /> and work on the site. <br /> Noise Levels <br /> On July 29, 2015, staff visited HiTech for additional noise testing. The tests evaluated the sound levels <br /> associated with moving vehicles in and out of the rear shop area, and sound exiting the building through <br /> an open service door on the west side of the building. <br /> POWERED 6T <br /> Template Updoted 4/14 INAWRE1 <br />
