MEETING OF THE ELK RIVER BOARD OF ADJUSTMENTS <br /> HELD AT ELK RIVER CITY HALL <br /> TUESDAY, AUGUST 24, 1999 <br /> Members Present: Chair Cote, Commissioners Chambers, Kuester, Mesich, <br /> Thompson and Schuster <br /> Members Absent: None <br /> Staff Present: Michele McPherson, Director of Planning; Scott Harlicker, Senior <br /> Planner; Debbie Huebner, Recording Secretary <br /> 1. Call Meeting To Order <br /> Pursuant to due call and notice thereof, the meeting of the Elk River Board of <br /> Adjustments was called to order at 6:30 p.m. by Chair Cote. <br /> 2. Consider 8/24/99 Board of Adjustments Agenda <br /> COMMISSIONER MESICH MOVED TO APPROVE THE AUGUST 24, 1999, BOARD OF <br /> ADJUSTMENTS AGENDA. COMMISSIONER CHAMBERS SECONDED THE MOTION. THE <br /> MOTION CARRIED 6-0. <br /> 3. Consider 7/27/99 Board of Adjustments Minutes <br /> COMMISSIONER THOMPSON TO APPROVE THE JULY 27, 1999, BOARD OF <br /> ADJUSTMENTS MINUTES. COMMISSIONER CHAMBERS SECONDED THE MOTION. THE <br /> MOTION CARRIED 5-0-1. Commissioner Mesich abstained. <br /> 4.1. Request by Mark Jorgenson for Variance from Setback for Septic System, Public <br /> Hearing Case No. V 99-10 <br /> Staff report by Scott Harlicker. Mark Jorgenson has requested a five foot variance <br /> from the 10 foot minimum setback from the property line, and an eight foot <br /> variance from the 20 foot minimum distance from any structure in order to <br /> construct a new septic system. Mr. Harlicker explained the site constraints and <br /> stated that the proposed location for the new septic system is the only option <br /> available to the property owner. Staff recommended approval of the variance <br /> based on the findings listed in the staff report to the Board dated August 24, 1999. <br /> Commissioner Kuester asked in the adjacent lot was buildable. Mr. Harlicker <br /> stated that if the property owner could meet the setback requirements, the lot <br /> would be buildable. <br /> Chair Cote opened the public hearing. There being no comments from the <br /> public, Chair Cote closed the public hearing. <br />
