�j <br /> Elk = - Request for Action <br /> River <br /> To Item Number <br /> Mayor and City Council 4.8 <br /> Agenda Section Meeting Date Prepared by <br /> Consent May 18, 2015 Tina Allard, City Clerk <br /> Item Description Reviewed by <br /> Ordinance Amendment: Hours for Alcohol Sales Cal Portner, City Administrator <br /> Reviewed by <br /> Action Requested <br /> Adopt, by motion, an ordinance amending Section 6-94 of the City Code regarding the sales of alcoholic <br /> beverages. <br /> Background/Discussion <br /> On May 1, 2015, new state liquor laws became effective including the Bloody Mary Lazar which changes the <br /> hours for the sale of intoxicating liquor on Sunday to 8 a.m. from 10 a.m. <br /> In order for this change to take effect in Elk River, the Council needs to approve an amendment to City <br /> Code. <br /> A request was made by The Sunshine Depot to match the new hours approved in state law. Businesses <br /> would like to be able to serve bloody mary's and mimosa's as part of their Sunday brunch specials. <br /> Staff also recommends a change to the hours for the sale of 3.2 percent malt liquor off-sale in order to be <br /> consistent with state law. If approved, sales can take place beginning at 10 a.m. instead of noon on <br /> Sundays. <br /> Cities can be more restrictive in liquor licensing and the Council wouldn't have to adopt these changes. <br /> There were more changes in the liquor laws, but staff will come back with those at a later date. They do <br /> not have as much of an effect on current liquor establishments.
