• RESOLUTION 83-9 <br /> A RESOLUTION AUTHORIZING THE CITY OF ELK RIVER TO ENTER INTO A <br /> COOPERATIVE AGREEMENT WITH THE STATE OF MINNESOTA FOR THE <br /> IMPROVEMENT OF HIGHWAY 10 <br /> WHEREAS, the State of Minnesota, Department of Transportation, proposes to make <br /> certain improvements on a portion of Trunk Highway No. 10 located in <br /> the City of Elk River in Sherburne County, upon and along T. H. 10, and, <br /> WHEREAS, it is the desire of the City that such improvements of said roadway <br /> along said street be_extended to greater width and capacity than is <br /> necessary to accommodate normal trunk highway traffic, from 0.3 miles <br /> NW of Jackson Street (T.H. 201) to 0.35 miles SE of Jackson Street (T.H. <br /> 201) to 0.35 miles SE of Jackson Street (T.H. 201) (a distance of approx- <br /> imately 3,000 ft) . <br /> BE IT RESOLVED by the Council board of the City of Elk River that the State of <br /> Minnesota, Department of Transportation is requested to provide for <br /> improvements on the aforesaid portion of Trunk Highway No. 10 con- <br /> sisting particularly of curb, gutter, and siedwalk in which the City <br /> will share in the cost. The approximate desired width between curb <br /> faces is 72 feet face of curb to face of curb and considered as con- <br /> • struction and improvement of said roadway to greater width and capacity <br /> than is necessary to accommodate normal trunk highway. <br /> BE IT FURTHER RESOLVED that following approval by the Minnesota Department of <br /> Transportation of plans and specifications for said improvements of <br /> said trunk highway and before a contract is awarded for the construction <br /> of said improvements, the City shall enter into an agreement with the <br /> State which shall provide that the City shall pay its share of the requested <br /> improvements as determined by the State in keeping with its latest edition <br /> of Minnesota Department of Transportation Directive •—Basic Policies and <br /> Procedures, Cooperative Construction Projects with Municipalities (a copy <br /> of which has been received from the Minnesota Department of Transportation's <br /> District Engineer) and, that if the State lets the construction contract, <br /> the municipality will deposit with the State upon demand, after the <br /> execution of the agreement and before the start of construction, a sum <br /> equal to an estimate of the City share as prepared by the Minnesota Depart- <br /> ment of Transportation. <br /> The City shall, in addition to paying its proportionate share of the cost <br /> of the proposed work, obtain at its sole cost and expense all necessary <br /> right of way easements and construction permits for the work to be per- <br /> formed outside the limits of the Trunk Highway or established City streets <br /> and roads, together with all drainage outlet rights where necessary. Such <br /> easements, permits and rights shall be obtained and certified copies of <br /> them furnished the Department of Transportation before any contract for <br /> • the proposed work is awarded. <br />
