RESOLUTION 83-7 <br /> A RESOLUTION AUTHORIZING THE CITY OF ELK RIVER TO ENTER INTO A COOPERATIVE <br /> AGREEMENT WITH THE STATE OF MINNESOTA FOR THE SIGNALIZATION AND IMPROVEMENTS <br /> OF THE INTERSECTION OF HIGHWAY 169 AND MAIN STREET <br /> WHEREAS, The City of Elk River proposes to make certain improvements on a portion <br /> of Trunk Highway No. 169 located in the City of Elk River in Sherburne <br /> County, adjacent to Main Street; and, <br /> WHEREAS, it is the desire of the City that such improvements of said roadway along <br /> said street be extended to greater width and capacity than is necessary <br /> to accommodate normal trunk highway traffic, Highway 169 and Main Street <br /> (a distance of approximately 100 ft. east or west of center line) . <br /> BE IT RESOLVED by the Council of the City of Elk River that the State of Minnesota <br /> Department of Transportation is requested to share in the cost on the <br /> aforesaid portion of Trunk Highway No. 169 consisting particularly of <br /> curb, gutter, and surfacing in which the City will also share in the cost. <br /> The approximate width between curb faces is 50 feet face of curb to face <br /> of curb on Main Street and considered as construction and improvement of <br /> said roadway to greater width and capacity than is necessary to accommodate <br /> • normal trunk highway traffic. <br /> BE IT FURTHER RESOLVED that following approval by the Minnesota Department of <br /> Transportation of plans and specifications for said improvement of said <br /> trunk highway and before a contract is awarded for the construction of <br /> said improvements, the City shall enter into an agreement with the State <br /> which shall provide that the City shall pay its share of the cost of the <br /> requested improvements as determined by the State in keeping with its <br /> latest edition of Minnesota Department of Transportation Directive - Basic <br /> Policies and Procedures, Cooperative Construction Projects with Munici- <br /> palities (a copy of which has been received from the Minnesota Department <br /> of Transportation's District Engineer) and, that if the State lets the <br /> construction contract, the municipality will deposit with the State upon <br /> demand, after the execution of the agreement and before the start of con- <br /> struction, a sum equal to an estimate of the City's share as prepared by <br /> the Minnesota Department of Transportation. <br /> The City shall, in addition to paying its proportionate share of the cost <br /> of the proposed work, obtain at its sold cost and expense, all necessary <br /> right of way easements and construction permits for the work to be per- <br /> formed outside the limits of the Trunk Highway or established City streets <br /> and roads, together with all drainage outlet rights necessary. Such <br /> easements, permits and rights shall be obtained and certified copies of <br /> them furnished the Department of Transportation before any contract for <br /> the proposed work is awarded. <br /> 4 <br />
