f 's <br /> STATE OF MINNESOTA <br /> Iv COUNTY OF SHERBURNE RESOLUTION 83-4 CITY OF ELK RIVER <br /> RESOLUTION OF CITY COUNCIL VACATING EASEMENT <br /> In the matter of the vacation of that public easement described <br /> on the attached Exhibit "A" . <br /> The above entitled matter came on to be heard before the City Council <br /> of the City of Elk River, Sherburne County, Minnesota, upon the Petition <br /> of Wallace E. Ohland and Irene D. Ohland and upon motion of the City <br /> Council for the vacating of the said public easement described on the <br /> attached Exhibit "A"; and the City Council having given due notice of <br /> said hearing by published and posted notice as provided by law and said <br /> 53 <br /> hearing having been held on the 14th day of February , 198 3 , at <br /> eight o'clock p.m. at the Elk River Public Library <br /> in said City, and no one appearing in opposition thereto and the said <br /> Council after hearing the evidence presented it in favor of said Petition <br /> finds: That said public easement is not serving any public purpose and <br /> 410 it would be in the best interest of the public to vacate said public <br /> ' easement; <br /> Councilman Duitsman introduced the following resolution, <br /> to wit: <br /> That the public easement as described on the attached Exhibit "A" <br /> be and the same hereby is vacated. <br /> Which resolution was seconded' by Councilman Schuldt and <br /> being put to a vote was passed by a unanimous vote in favor of said resolution <br /> by all members of the City Council whereupon said resolution was declared <br /> adopted by the Mayor of said City. <br /> Dated at the City of Elk River, <br /> this 23rd day of February , 198 3 . <br /> Mayor <br /> 010110 Attest: <br /> Administrator lerk <br /> STATE OF MINNESOTA I <br /> COUNTY OF SHERBURNE <br /> Robert Middaugh being first duly sworn says that he is the duly appointed <br /> ' and acting City Clerk of the City of Elk River, Sherburne County, Minnesota, <br /> and as custodian of said resolutions and minutes of said City Council <br /> of said City, for the regular meeting held thereof on <br /> February 14 , 1953 <br /> R64.-rt Midda <br />
