EXHIBIT B <br /> • EXTRACT OF MINUTES OF MEETING OF THE <br /> CITY COUNCIL OF THE CITY OF <br /> ELK RIVER, MINNESOTA <br /> HELD: AUGUST 17, 1981 <br /> Purusant to due call and notice thereof, a regular meeting of the City <br /> Council of the City of Elk River, Sherburne County, Minnesota was duly held at the <br /> Elk River Public Library on the 17th day of August, 1981 at 8:00 o'clock P.M. <br /> The following members were present: Mayor Hinkle, Councilmembers Duitsman, <br /> Toth and Schuldt and the following were absent: Councilman Engstrom. <br /> Member Toth introduced the following resolution and moved its adoption: <br /> RESOLUTION 81-36, ORDERING THE COMPLETION OF THE IMPROVEMENTS TO GREENHEAD ACRES <br /> 3RD ADDITION AND AWARDING THE BID TO BUFFALO BITUMINOUS, INC. IN THE AMOUNT OF <br /> $147,086. <br /> WHEREAS, the City Council has received a petition pertaining to street and storm <br /> sewer improvements located on Vernon Street N.W. , York Street N.W., 210th Circle <br /> N.W. , 212th Avenue N.W., all located entirely within the Greenhead Acres 3rd Addition <br /> Subdivision. <br /> 410 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, <br /> Minnesota as follows: <br /> a. the aforesaid petition is signed by all the owners of real property <br /> abutting upon the streets named as the location of the improvements in the <br /> petition, <br /> b. said property owners request in the petition that the improvement be <br /> constructed and that the entire cost of the improvement be assessed against <br /> their property, <br /> c. the consulting Engineer has recommended that said improvement is <br /> feasible and can best be made as proposed. <br /> and said improvement is hereby ordered and the bid awarded to Buffalo Bituminous, <br /> Inc. in the amount of $147,086. <br /> The motion for the adoption of the foregoing resolution was duly seconded <br /> by.member Duitsman and upon vote being taken thereon, the following voted in <br /> favor thereof: . Mayor Hinkle, Councilmembers Duitsman, Toth and Schuldt and <br /> the following voted against the same: None. <br /> Whereupon said resolution was declared passed and adopted. <br /> ATTEST: <br /> Robert C.
