-'ity of <br /> <br />iver <br /> <br />M£MORANDLIM <br /> <br />Item # 4.2. <br /> <br />TO: <br /> <br />FROM: <br /> <br />DATE: <br /> <br />SUBJECT: <br /> <br />Mayor and City Council <br /> <br />Sandra Peine, City Clerk <br /> <br />March 13, 2000 <br /> <br /> Liquor Ordinance <br /> <br />Request <br /> <br />The City of Elk River is requesting to repeal the existing liquor ordinance in <br />its entirety and to adopt a new liquor ordinance. <br /> <br />Overview <br /> <br />This ordinance was redrafted with the assistance of the City Attorney. State <br />Law and examples from other Minnesota cities were used in the redrafting of <br />the ordinance. <br /> <br />There are two main reasons for adopting a new liquor ordinance. <br /> <br />1) To bring the city's ordinance into conformance with the state law. <br /> <br />2) <br /> <br />To clearly spell out the penalties for violations relating to the liquor <br />ordinance. <br /> <br /> During the last liquor compliance check, the council was requested to <br />impose a penalty for an establishment that failed the compliance check. <br />Because the city did not have a uniform penalty for violators, the Council felt <br />that it would be unfair to be arbitrary in setting penalties. The council <br />indicated that it wanted to see some consistency in issuing liquor violation <br />penalties. This ordinance clearly defines specific penalties for liquor <br />violations in a violation grid on page 16 of the ordinance. <br /> <br />13065 Orono Parkway · P.O.
