Park dedication fees were applied to the new plat <br /> consistent with what was directed by the Council in 2006, for the Plat of Jabez. This memo is intended to <br /> provide additional background and clarify the concerns. <br /> In 2006, the property owner of the Elk River Ford car dealership proposed a plat combining several <br /> unplatted parcels into three lots, a 17.73 acre lot for the car dealership, and two outlots. Payment of park <br /> dedication fees for oudots is due when platted as outlots, by definition, are not developable. <br /> At that time,the applicant convinced the Council that park dedication fees are due only to the <br /> undeveloped portion of the plat, or for the 8.05 acres not part of the already operating Elk River Ford <br /> dealership. This was inconsistent with past practice. In Cornerstone's case, 9.68 acres were developed as <br /> the Elk River Ford car dealership. <br /> ERX operates a recreational vehicle amusement facility on Highway 169, and received an Interim Use <br /> Permit in 2009. The parcel on which ERX operates is unplatted and is proposed to be combined with <br /> portions of other parcels as part of the Aggregate Commercial 2nd Addition. Staff applied park dedication <br /> fees to the portion of the lot 1, block 1 that was added to the ERX site. In the ERX case,this is 12.75 <br /> acres of their proposed 26.02 acre lot. <br /> It is expected that park dedication fees will be reviewed as part of the Park Master Plan,though this is <br /> likely to occur later in the summer.
