Elk River <br /> Municipal Utilities UTILITIES COMMISSION MEETING <br /> TO: FROM: <br /> Elk River Municipal Utilities Commission Troy Adams, P.E. —General Manager <br /> John Dietz—Chair <br /> Al Nadeau—Vice Chair <br /> Daryl Thompson—Trustee <br /> MEETING DATE: AGENDA ITEM NUMBER: <br /> January 14, 2014 6.1a <br /> SUBJECT: <br /> Staff Updates—General Manager <br /> DISCUSSION: <br /> • In the first days as President of the Minnesota Municipal Transmission Group (MMTG) <br /> there has been the following action taken: <br /> o MMTG has filed a motion to intervene and comment on Federal Energy <br /> Regulatory Commission (FERC) Docket No. EL14-12-000, the Midcontinent <br /> Independent System Operator(MISO) FERC rate of return case. On November <br /> 12, 2013, a number of industrial customers including the Association of Business <br /> Advocating Tariff Equality(ABATE) filed a complaint against MISO and MISO <br /> owners alleging that their equity rate of return are unjust and that transmission <br /> costs are unnecessarily high. The purpose for the filing was to put into record in <br /> this case MMTG's support of the hypothetical capital structure. This filing is <br /> attached for reference. <br /> o MMTG has granted Spiegel &McDiarmid a waiver to represent others regarding <br /> the rate of return and equity capital structure transmission issues. <br /> o MMTG has filed comments on FERC Docket No. AD13-7-000, Post-Technical <br /> Conference Comments of Midwest Transmission-Dependent Utilities (TDUs). <br /> These comments are to document MMTG's position on Minimum Offer Price <br /> Rule(MOPR) and voice the position that MMTG doesn't want the eastern RTOs' <br /> capacity market constructs do not extend to MISO. This filing is attached for <br /> reference. <br /> • The City of Elk River's Safety Committee is working on adding and updating a number <br /> of safety policies. ERMU has offered the use of our safety policies to use as templates. <br /> Staff will be working with the City on this process. <br /> • I have been elected as the Elk River Rotary President Elect for 2014 and will be Rotary <br /> President in 2015. <br /> • Staff is working on auditing our pole attachment agreements. This has involved field <br /> inspections, contract review, and billing audits.
